1. Who we are
These Terms & Conditions ("Terms") govern your access to and use of the REAL Provider certification, training, and verification services (the "Service") operated by REAL Provider ("we", "us", or "our"). By creating an account, purchasing a certification, or otherwise using the Service, you agree to be bound by these Terms.
2. Acceptance
By continuing to access or use the Service you confirm that you have read, understood, and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
3. The Service
REAL Provider is an independent compliance training, identity-verification, and certificate-issuance program for healthcare providers. The Service is notaffiliated with, endorsed by, or part of the Centers for Medicare & Medicaid Services (CMS), the Department of Health and Human Services (HHS), Medicare, or any state agency. Certification is a private corporate operational standard, not a government requirement.
4. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- use the Service for any unlawful, fraudulent, or deceptive purpose;
- submit false identity, NPI, PTAN, or registry information;
- infringe the intellectual property or privacy rights of others;
- interfere with the security or integrity of the Service (including probing, scraping, malware, or attempts to bypass access controls);
- resell, sublicense, or misrepresent your certification status.
5. Intellectual property
All software, training content, certificates, marks, and materials made available through the Service are owned by REAL Provider or its licensors and are protected by intellectual-property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your own internal business purposes during your active subscription term.
6. Payments, subscriptions, and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing, applicable taxes, cancellations, and refund mechanics are governed by the Paddle Checkout Buyer Terms in addition to these Terms.
Certifications are sold on an annual basis and auto-renew each year unless cancelled. Installment plans charge a deposit today and the remaining balance in monthly installments as disclosed at checkout. You may cancel at any time via the customer portal at paddle.net.
7. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated policy violations. Upon termination your right to use the Service ends; provisions that by their nature should survive (IP, disclaimers, liability, governing law) survive termination.
8. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, REAL Provider disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free.
9. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including lost profits, lost revenue, or loss of data.
10. Governing law
These Terms are governed by the laws of the United States and the state in which REAL Provider is organized, without regard to conflict-of-laws rules.
